In the wake of both the semiotic and the psychoanalytic revolutions, how is it possible to describe the object of religious worship in realist terms? Semioticians argue that each object is known only insofar as it gives birth to a series of signs and interpretants (new signs). From the psychoanalytic side, religious beliefs are seen to belong to transference energies and projections that contaminate the religious object with all-too-human complexes. In Nature's Religion, distinguished theologian and philosopher Robert S. Semiotic theory, which has restricted its focus largely to human forms of significations, is transformed by Robert S. Corrington into a semiotics of nature itself. Corrington situates the divide between "nature naturing" and "nature natured" within the contest of classical American pragmaticism and postmodern psychoanalysis. At the heart of this new metaphysics is an insistence that all signs participate in larger orders of meaning that are natural and religious. Numerous labor-management issues possess ethical dimensions and pose ethical questions. In this article, the authors discuss four labor-management issues that present important contemporary problems: union organizing, labor-management negotiations, employee involvement programs, and union obligations of fair representation. In the authors view, labor and management too often view their ethical obligations as beginning and ending at the law''s boundaries. Contemporary business realities suggest that cooperative and enlightened modes of interaction between labor and management seem appropriate.

Rawls offers three arguments for the priority of liberty in Theory, two of which share a common error: the belief that once we have shown the instrumental value of the basic liberties for some essential purpose (e.g., securing self-respect), we have automatically shown the reason for their lexical priority. The third argument, however, does not share this error and can be reconstructed along Kantian lines: beginning with the Kantian conception of autonomy endorsed by Rawls in section 40 of Theory, we (...) can explain our highest-order interest in rationality, justify the lexical priority of all basic liberties, and reinterpret Rawls’ threshold condition for the application of the priority of liberty. Perhaps unsurprisingly, this Kantian reconstruction will not work within the radically different framework of Political Liberalism. (shrink)

ABSTRACT:Despite sustained attention to ethical leadership in organizations, scholarship remains largely descriptive. This study employs an empirical approach to examine the consequences of ethical leadership on leader promotability. From a sample of ninety-six managers from two independent organizations, we found that ethical leaders were increasingly likely to be rated by their superior as exhibiting potential to reach senior leadership positions. However, leaders who displayed increased ethical leadership were no more likely to be viewed as promotable in the near-term compared to (...) those who displayed less ethical leadership. Our findings also show ethical culture and pressure to achieve results are important contextual factors that moderate the relationships between ethical leadership and leader promotability to senior leadership roles. The republican tradition has long been ambivalent about markets and commercial society more generally: from the contrasting positions of Rousseau and Smith in the eighteenth century to recent neorepublican debates about capitalism, republicans have staked out diverse positions on fundamental issues of political economy. Rather than offering a systematic historical survey of these discussions, this chapter will instead focus on the leading neo-republican theory—that of Philip Pettit—and consider its implications for market society. As I will argue, Pettit’s theory is even (...) friendlier to markets than most have believed: far from condemning commercial society, his theory recognizes that competitive markets and their institutional preconditions are an alternative means to limit arbitrary power across the domestic, economic, and even political spheres. While most republican theorists have focused on political means to limit such power—including both constitutional means (e.g., separation of powers, judicial review, the rule of law, federalism) and participatory ones (democratic elections and oversight)—I will examine here an economic model of republicanism that can complement, substitute for, and at times displace the standard political model. Whether we look at spousal markets, labor markets, or residential markets within federal systems, state policies that heighten competition among their participants and resource exit from abusive relationships within them can advance freedom as non-domination as effectively or even more effectively than social-democratic approaches that have recently gained enthusiasts among republicans. These conclusions suggest that democracy, be it social or political, is just one means among others for restraining arbitrary power and is consequently less central to (certain versions of) republicanism than we may have expected. So long as they counteract domination, economic inroads into notionally democratic territory are no more worrisome than constitutional ones. (shrink)

Robert S. Summers is a distinguished legal theorist whose work has had significant influence in Europe as well as the United States. The study of form and substance in law, the theme of this collection, marks many of his most distinctive contributions to law and legal philosophy over four decades.

In setting forth a new theory of the growth of scientific knowledge, Larry Laudan shows that any account of scientific change has consequences for the relationship between the history, philosophy and sociology of science. It is a laudable feature of his work that he does not treat any of these disciplines as undifferentiated monoliths. In fact, one of his main goals is to show that his account of progress requires specific ways of doing and relating these three disciplines. As an (...) historian invited to speak at the Philosophy of Science Association, it seemed appropriate for me to appraise the function of history of science in Laudan’s program. Without going into unnecessary detail, let me begin by examining some of his main claims.The focus of Laudan’s argument is on science construed as a form of problem-solving activity and on progress and rationality as appraisals of problem-solving capabilities. Social judgement theory is particularly well suited to the study of medical judgements. Medical judgements characteristically involve decision making under uncertainty with inevitable error and an abundance of fallible cues. In medicine, as in other areas, SJT research has found wide variation among decision makers in their judgements and in the weighting of clinical information. Strategies inferred from case vignettes differ from physicians' self-described strategies and from the weights suggested by experts. These observations parallel recent findings of unexplained variation in (...) diagnosis and management in clinical practice that have been the source of concern in the medical community. The lens model provides one of the few methods for quantitatively analysing physicians' judgements. Contrary to what one might expect from the variation in strategies on paper cases, several studies suggest that, in practice, physicians' diagnostic judgements are highly accurate. Cognitive feedback has been less successful as a practical teaching tool than originally hoped, but some aspects of this methodology show promise, particularly in conjunction with the increasing emphasis on statistical decision support. All things considered, SJT has provided insight into physicians' decisions and gives the medical research community important tools for studying judgements in actual practice. (shrink)

In this book Robert Tragesser sets out to determine the conditions under which a realist ontology of mathematics and logic might be justified, taking as his starting point Husserl's treatment of these metaphysical problems. He does not aim primarily at an exposition of Husserl's phenomenology, although many of the central claims of phenomenology are clarified here. Rather he exploits its ideas and methods to show how they can contribute to answering Michael Dummet's question 'Realism or Anti-Realism?'. In Artemovʼs Justification Logic, one can make statements interpreted as “t is evidence for the truth of formula F.” We propose a variant of this logic in which one can say “I have degree r of confidence that t is evidence for the truth of formula F.” After defining both an axiomatic approach and a semantics for this Logic of Uncertain Justifications, we will prove the usual soundness and completeness theorems.

Truth is a fundamental objective of adjudicative processes; ideally, substantive as distinct from formal legal truth. But problems of evidence, for example, may frustrate finding of substantive truth; other values may lead to exclusions of probative evidence, e.g., for the sake of fairness. Jury nullification and jury equity. Limits of time, and definitiveness of decision, require allocation of burden of proof. Degree of truth-formality is variable within a system and across systems.

This volume contains the English translation of Felix Kaufmann's (1895-1945) main work Methodenlehre der Sozialwissenschaften (1936). In this book, Kaufmann develops a general theory of knowledge of the social sciences in his role as a cross-border commuter between Husserl's phenomenology, Kelsen's pure theory of law and the logical positivism of the Vienna Circle. This multilayered inquiry connects the value-oriented reflections of a general philosophy of science with the specificity of the methods and theories of the social sciences, as opposed to (...) abstract natural science and psychology. The core focus of the study is the attempt to elucidate how and under what conditions scientific knowledge about social facts, empirically justified and theoretically embedded, can be obtained. The empirical basis of knowledge within the social sciences forms a phenomenological concept of experience. According to Kaufmann, this concept of experience exhibits a complex structure. Within the meaning-interpretation of human action as the core of knowledge in the social sciences, this structure reaches out across the isolated act of verification toward the synthesis of external and internal experiences. The book opens with a detailed and useful introduction by Ingeborg K. Helling, which introduces the historical and theoretical background of Kaufmann's study and specifically illuminates his relation to Alfred Schütz and John Dewey. Finally, it contains interviews with and letters to members of his family, colleagues and students. (shrink)

In separate reviews of The Copernican Question published in the Summer 2012 issue of this journal, Noel Swerdlow and John Heilbron find little that meets their approval while failing to provide readers with a full and accurate summary of the book’s major claims and arguments.* The reviewers engage in an exercise in deconstructive surgery, essentially breaking down and reconstituting the work into separate studies. Swerdlow, who devotes most of his twenty-five page treatment to chapter 3 (with brief side-glances at the (...) introduction, chapters 1, 8, and 11), leaves the impression that my book is almost entirely about Copernicus. Henderson Scholarly reflection on Hume's "doctrine" ofselfand personal identity continues to focus on the sections "Of Personal Identity" and the "Appendix" toA Treatise ofHuman Nature. To answer the question of why we have so great a propension to ascribe an identity to these successiveperceptions which make up experience, Hume says that we must distinguish betwixtpersonal identity, as (...) it regards our thought or imagination, and as it regards our passions or the concern we take in ourselves. He considers only the former in these sections. Towards the end of the personal identity section he writes that our identity with regard to the passions serves to corroborate that with regard to the imagination, by the making our distant perceptions influence each other, and by giving us a present concern for ourpast or future pains or pleasures (T 261). In the advertisement to the Treatise Hume says that the subjects of the understanding and passions make a compleat chain of reasoning by themselves (T xii). In light of the importance Hume attaches to the distinction, and since there are many indications that the Treatise should be read as an integral whole, it is surprising that so little attention is given to what he says of personal identity in the other books. As the title suggests, this paper concentrates on the second part of the distinction and especially on the discussion ofthe indirectpassions in Book II of the Treatise. This is not to suggest that self does not play an important role elsewhere in Hume's science ofman; for example, it is selfwhich experiences the impression ofwill and the direct passions. However, the indirect passions have a particularly important part to play in ascriptions of personal identity and this justifies the present investigation. II We can safely predict that personal identity as it regards our passions will not be the idea??some philosophers whose views of self as having the philosophical (strict) relation ofidentity Hume has rejected in "Of Personal Identity." The relationship between thought and passion to which he draws attention suggests that the idea of selfin this context has a relation to the positive suggestions in that earlier section of why Volume XVI Number 1 33 ROBERT S. Perceptions are either impressions or ideas which derive from impressions. Hume describes the indirect passions as secondary or reflective impressions and these stem from original impressions or from their ideas. He distinguishes between direct andindirect passions. Directpassionsarise immediately fromgood or evil, frompain orpleasure (T 276). Examples are joy, hope and fear. Indirect passionsproceed from the same principles, but by the conjunction ofother qualities (T 276). That is, the indirect passions not onlyhave a cause (an impression which excites them), but also an object (to which the passion directs our view when excited). We shall see that a significant quality of the indirect passions is the relation of these impressions to their objects, which are either one's own or another's self. In Book II of the Treatise Hume examines the indirect passions: love, hate, pride and humility. These passions are evaluations of persons; of selfin the case of pride and humility, and of another in the case of love and hatred. Evaluation of persons is a central feature of Hume's moral philosophy: To have the sense ofvirtue, is nothing but to feel a satisfaction of a particular kind from the contemplation of a character. "Whole brain death" (neurological death) is well-established as a legal standard of death across the country. Recently, New Jersey became the first state to enact a statute recognizing a personal religious exemption (a conscience clause) protecting the rights of those who object to neurological death. The Act also mandates adoption through the regulatory process of uniform and up-to-date clinical criteria for determining neurological death.

This book introduces Robert Corrington’s “ecstatic naturalism,” a new perspective in understanding “sacred” nature and naturalism, and explores what can be done with this philosophical thought. This is an excellent resource for scholars of Continental philosophy, philosophy of religion, and American pragmatism.

Contemporary republicanism is characterized by three main ideas: free persons, who are not subject to the arbitrary power of others; free states, which try to protect their citizens from such power without exercising it themselves; and vigilant citizenship, as a means to limit states to their protective role. This book advances an economic model of such republicanism that is ideologically centre-left. It demands an exit-oriented state interventionism, one that would require an activist government to enhance competition and resource exit from (...) dominating relationships within markets of all types, be they marital, labour, or residential. The substantial intervention and redistribution necessitated by such an approach make it leftist, while its tendency to work with rather than against the grain of markets makes it centrist. It is, in short, a contribution to progressive republican political thought, but one that is less social-democratic than market-democratic in character. (shrink)
